Lust Home Privacy Policy

This policy explains what personal information we collect when you visit lusthome.com or shop with Lust Home, how we use and share it, how long we keep it, and the rights you have over it. Nothing in it takes away any right you have under data protection law. We do not sell your personal information.

 

1. Who we are

Lust Home is a trading name of Henderson Design Group Ltd, a company registered in England and Wales under company number 03653986, with its registered office at Head Office, Oakesway, Hartlepool, TS24 0RE, United Kingdom (VAT number GB721821949).

Henderson Design Group Ltd is the data controller for the personal information described in this policy, and is the data controller across all of its trading names. We are registered with the Information Commissioner’s Office (ICO) as Henderson Design Group Limited.

We are not required to appoint a Data Protection Officer and have not done so. Privacy questions and requests are handled by our customer service team:

2. What information we collect, and where it comes from

Information you give us directly:

 

• Order and account details: your name, billing and delivery addresses, email address, phone number, order history, and the payment method you choose (we do not see or store your full card number; payments are handled by our payment service providers, see section 4).

• Made-to-order details: where you order a mural or other made-to-order product, the measurements or dimensions you enter and any images or content you upload.

• Marketing preferences: whether you have opted in to emails, SMS or other channels, and your engagement with our messages.

• Customer service correspondence: what you tell us when you contact us by email, phone, chat or social media, including photographs you send us of a product issue.

• Reviews, submitted content and competition entries: reviews, photographs, videos and other content you submit to us or agree we may use, any name or handle you provide with it, and your details when you enter a prize draw or promotion.

Information collected automatically when you use our site:

 

• Device and usage data: IP address, browser type, device identifiers, the pages and products you view, search terms, and how you arrived at and move around the site. Cookies and similar technologies collect most of this, and only with your consent where the law requires it (see section 8).

 

Information we receive from others:

 

• Payment and buy-now-pay-later providers: confirmation that your payment succeeded or failed, and fraud-risk signals.

• Fraud-prevention services: risk indicators about a transaction (for example, whether a card or address has been linked to fraud).

• Delivery partners: delivery status, and updated address or delivery-preference information you give the courier.

• Independent review platforms: reviews you publish about us on those platforms.

 

You are not obliged to give us any of this information, but without your name, contact details, delivery address and payment we cannot enter into or perform a contract with you or deliver your order.

3. How we use your information, and our legal grounds

 

UK data protection law requires us to have a lawful basis for each way we use your personal information. This table sets them out.

 

 

Where we rely on legitimate interests, we have balanced our interests against your rights, and you may object at any time (section 9). Where we rely on consent, you may withdraw it at any time; withdrawal does not affect processing carried out before you withdrew it.

4. Who we share your information with

 

We share personal information only as this policy describes, and we do not sell it. Our main recipients are:

 

• Our ecommerce platform provider: hosts our store and processes customer data on our behalf. Where you use payment or account services operated by the platform itself, the platform also processes some of your data for its own purposes as an independent controller under its own privacy notice.

• Payment service providers and card networks: depending on how you pay, your payment is processed by one or more payment service providers and the relevant card networks. Each processes your data as an independent controller under its own privacy notice for purposes such as processing the payment and preventing fraud.

• Buy-now-pay-later (BNPL) providers: if you choose a BNPL option shown at checkout, we share your identity, contact, delivery and order details with that provider. The provider is an independent controller: it makes its own decisions about your data, including affordability, creditworthiness and fraud checks (which may involve credit reference agencies), under its own privacy notice, which is shown to you when you choose that option.

• Email and SMS marketing providers: send our order emails and, where permitted, our marketing messages, and record how you interact with them (for example opens and clicks) on our behalf.

• Helpdesk providers: the platforms our team uses to answer your messages and manage your queries.

• Delivery partners: the couriers and postal services who deliver your order and handle returns (including providing a prepaid return label) receive your name, delivery address, contact details and parcel information so they can deliver, keep you updated and arrange collection where offered.

• Independent review platforms: platforms through which we may invite you to review your purchase. These platforms act as controllers of the reviews you publish with them, under their own privacy notices.

• Analytics and advertising providers: receive information about your visit so we can understand how our site is used and show and measure relevant ads. Where your local law requires consent, this happens only if you consent through our cookie banner, which names the providers active on this site before you choose; elsewhere we honour the opt-out rights described in section 8.

• Fraud-prevention services: used to screen orders as described in section 10.

• Professional advisers and authorities: our accountants, insurers, legal advisers, banks, and public authorities where the law requires disclosure (for example HMRC, or a court order).

• A buyer of our business: if Henderson Design Group Ltd or a brand is sold or reorganised, your information may transfer to the new owner, who must use it consistently with this policy.

5. Marketing

 

We send marketing where you have consented or where the law otherwise permits. You may opt out of marketing at any time. Marketing may relate to other brands operated by Henderson Design Group Ltd where the law permits.

 

Content you submit to us, or post about us and agree we may use, together with any name, username or handle you provide, may be used in our marketing, on the terms set out in our Terms & Conditions. You may ask us to stop new uses at any time using the contact details in section 1.

6. International transfers

 

We are based in the UK, but some of the providers in section 4 store or process data outside the UK, including in Canada and the United States. Some destinations benefit from UK adequacy regulations; other transfers are safeguarded by approved mechanisms appropriate to the provider and destination, such as standard contractual clauses incorporating the UK International Data Transfer Addendum (IDTA), binding corporate rules, or a provider’s certification under the UK Extension to the EU-US Data Privacy Framework. Providers acting as independent controllers (for example advertising providers) may also transfer data internationally under equivalent safeguards, described in their own notices.

 

Whenever your data leaves the UK, a lawful transfer mechanism protects it: UK adequacy regulations for the destination country, or an approved safeguard such as those described above. You may ask us for more information about the safeguard used for any transfer, or a copy of the relevant clauses, using the contact details in section 1.

7. How long we keep your information

 

We keep personal information only for as long as it is needed for the purposes described in this policy, including for as long as the law requires records to be kept.

8. Cookies and similar technologies

 

Our site uses cookies, pixels and similar technologies. Where the law of your location requires consent (for example in the UK, the EU/EEA and countries with equivalent rules), a cookie banner asks for your choices when you first visit, before any non-essential technologies are set. Accepting and rejecting are equally easy, and you can choose by category:

 

• Strictly necessary: make the site work, including your basket, checkout, login and security, and fraud prevention. These do not need consent and cannot be switched off.

• Analytics and performance: help us understand how the site is used so we can improve it. Set only with your consent, where your local law requires consent.

• Advertising and social media: used by advertising providers to show you relevant ads elsewhere and measure our campaigns. Set only with your consent, where your local law requires consent.

• Preferences: remember choices such as region or display settings. Set only with your consent, where your local law requires consent.

 

Where local law does not require prior consent (for example in most of the United States), we use the technologies described here without asking first, and we honour any opt-out rights your local law gives you, including US state rights to opt out of the “sale” or “sharing” of personal information, and browser-based Global Privacy Control (GPC) signals, which we treat as a valid opt-out.

 

The banner lists the specific technologies and third parties active on this site. You can change or withdraw your choices at any time, as easily as you gave them, via the “Cookie settings” link in our website footer. You can also control cookies through your browser settings, though blocking strictly necessary cookies may stop parts of the site working.

9. Your rights

 

The rights in this section apply where UK data protection law, or equivalent local law, applies to you. Where it does, you have the following rights over your personal information:

 

1. To be informed: to know how your data is used (this policy).

2. Access: to obtain a copy of the personal information we hold about you.

3. Rectification: to have inaccurate or incomplete information corrected.

4. Erasure: to have your information deleted where we no longer need it (this does not apply to records the law requires us to keep).

5. Restriction: to ask us to pause using your information in certain situations, for example while we check a challenge to its accuracy.

6. Portability: to receive the information you gave us in a machine-readable format, or have it sent to another provider, where technically feasible.

7. Objection: to object to processing based on legitimate interests, and an absolute right to object to direct marketing; if you object to marketing, we will stop.

8. Rights in relation to automated decision-making, where they apply under data protection law.

 

You may withdraw any consent at any time, and you may opt out of marketing at any time. The “Cookie settings” link in our website footer changes your cookie choices.

Requests are free of charge and we will respond within one month (extendable by up to two further months for complex requests, in which case we will tell you). We may need to verify your identity first. Where your request concerns data a provider holds as its own independent controller (for example a payment service provider), we may direct you to that provider so you can exercise your rights with it directly.

10. Automated fraud screening

 

Automated screening is used to help detect and prevent fraud. Orders are screened before dispatch against indicators of fraud risk (for example, whether the payment details, addresses and device used match patterns associated with fraud), and an order may be declined or cancelled as a result. We do not use automated decision-making for any other purpose that produces legal or similarly significant effects on you. Your rights under data protection law are set out in section 9.

11. Children

 

Our sites sell home décor to adults and are not directed at anyone under 18; you must be 18 or over to buy from us. We do not knowingly collect personal information from children. If you believe a child has given us personal information, contact us and we will delete it.

12. How to complain

 

If you are unhappy with how we have handled your personal information, you may complain to us or to the Information Commissioner’s Office.
